<p>Does anyone know within Canada, and USA the <br /> following:  </p>
<p>If company A imports a diagnotic kit to resell in Canada or USA to the <br /> government labs and hospital core labs &#8212; are there certain laws with <br /> respect to the following example.  </p>
<p>Lets say the kit uses to a stool sample, or blood sample from a hospital <br /> patient and determines a diagnosis of a type of bacterial or viral <br /> infection. &nbsp;Many labs do diagnostic work and thus may use these kits. &nbsp;Do <br /> they need special FDA or Health Canada approval before a company can sell <br /> them.  </p>
<p>I understand that for example a HIV diagnostic kits cannot be sold to the <br /> public at the pharmacies unless clinical trials are carried out and approval <br /> is given by the government&#8230; however to sell these kind of kits to be used <br /> as a diagnotic aid or tool in hospitals and government labs may not require <br /> approval.  </p>
<p>Please help. </p>
